What personal data we collect
We have to collect your personal data to enable you to use our services but some of it will be optional. We’ll make it clear when you have a choice and when we need the data to provide our services to you. For some information if you don’t provide it we won’t be able to do business with you.
We collect your personal details including name, address, title and date of birth. Your address may include delivery addresses and billing addresses. We will also collect other contact details such as your email address and phone numbers.
We collect some financial data to enable transactions, that might include bank account sort codes and account numbers and also payment card details when we take a payment from you.
We collect details about your dealings with us including details of your devices, IMEI numbers, financial transactions and services you have bought from us.
Sometimes you might take part in a customer experience or website survey and where you do, we will collect information about your preferences and the answers you give.
When you use our website information about how you use it and the links you clicked on will be collected to help us improve our website.
We collect details about your identity, proof of purchase/use of devices, crime reference numbers and other details we need to verify your claim and prevent fraud. We may also collect details about you from fraud and barring databases. This information may include criminal offence data.
We may also collect details about your communications or marketing preferences.
We may collect information about any particular vulnerabilities you have and this may include sensitive information about your health. This data, known as special category data, will be subject to a higher degree of security and we will heavily restrict its use.
If you are using the App on an Apple device we may also collect information from your camera and use the TrueDepth APIs to do so. We don’t collect any personal information about you as we do not use them while taking pictures of you. We only use them to accurately position your device in a photo and to detect any faults or physical damage accurately when you make a claim. It may also use audio for similar purposes and will need to access your photo library to access the photos you take. We also collect location data to inform you of nearby facilities that may be of use to you.
If you are using the App on an Android device we may also collect information from your camera, your photo library and your phone sensors to accurately diagnose any faults with the phone and the health of its battery. We will also collect location data to inform you of nearby facilities that may be of use to you.
We will receive information about you from our Insurance Distribution Partner such as online identifiers or details of the products you have subscribed to or purchased. This may mean we have not collected it directly from you but it will save you the job of giving it to us separately.
It is important that the personal data we hold about you is accurate and current. Please keep us informed either directly or through the Insurance Distribution Partner if your personal data changes during your relationship with us, for example a new address or email address.
Our lawful bases for using your data
Data Protection law means we need one of a number of things called lawful bases to use your data. Consent is one of them, but there are a few others. In this section we explain which ones we use for what.
We need your contact details, financial information, addresses and your date of birth to enable us to provide our services, such as providing you with device protection or enabling you to use our repair services. This lawful basis is that we need the data to fulfil our contract with you or to take steps to enter into a contract with you.
We also need all your device details, including the IMEI number to enter into a contract with you.
We also have to collect and keep much of this data to retain accurate financial records about our transactions. This lawful basis is known as complying with a legal obligation.
Some of the data we have to collect from you will be to help us service our relationship with our Insurance Distribution Partner. This will mainly be to deal with customer service issues or to report on the success measures we use for our partnership. Our lawful basis is that it is in our legitimate interests to do this in order to maintain our business relationship with Barclays
Your survey data and technical data about the way you use our site are used because it is in our legitimate interests to improve our site and our services.
Sometimes we have to use your contact details to send you required documentation (such as changes to our terms and conditions or sometimes this privacy policy). We do this when it is a legal obligation.
Where we have to collect special category data about a vulnerability or specific need you may have we will collect this on the basis of your explicit consent. If you are not able to give clear consent we rely on the need to protect an individual from economic harm. This makes sure that when we collect that information we protect it and don’t allow anyone in our organisation to access or use it unnecessarily.
Where you make a complaint to us or to another organisation such as the Financial Ombudsman Service, and that complaint is about a matter regulated by the Financial Conduct Authority we will process this personal data on the basis of compliance with a legal obligation.
Where we share your details with service providers (for example couriers) we do this on the basis that it is necessary for the performance of our contract with you.
We perform checks and have processes to detect and prevent fraud. Our lawful basis for this is that it is in our legitimate interests to detect and prevent fraud to prevent loss to our business. We use CIFAS products and their fair processing notice can be found here: https://www.cifas.org.uk/fpn; We also use Synectics and their fair processing notice can be found here: https://www.synectics-solutions.com/privacy-policy
Who we share your data with
The first group of people we share your data with are other companies in the Likewize group. We have internal group contracts that specify what they can do with your data and what security processes they have to follow. Different companies in our group do different things, for example one company may do our IT development and another might provide cyber-security. We are a multinational group and some of these companies are in countries with different Data Protection laws. Where this is the case, we put in place specific contracts approved by the UK Information Commissioner’s Office to keep your data safe and secure.
The second group of people we share your data with are service providers such as our specialist payment provider, professional advisors, auditors and so on. These help us make our website work and for data such as payment card data they help us to keep your data more secure. Again, some of these providers are based overseas so we enter into appropriate contracts to keep your data secure and follow the law.
Thirdly are regulators and other public authorities that we are required to share data with such as HMRC or the FCA.
We also share information with our Insurance Distribution Partner.
Finally we may share your details with fraud prevention agencies, some of them specific to the telecommunications sector. We use industry standard and reputable organisations to both check your data against and to share relevant data with.
If you want more details about our international data transfers please contact us using the details at the top of this page.
We don’t sell your personal data to others, and we only share it for the purposes of providing our services.
How long we keep your data for
The general rule is that we only keep your data for as long as we absolutely need it but there are some specific timescales to keep in mind.
Where a financial transaction has taken place, so where you have purchased a service from us, we will keep the data for six years plus the remainder of the current financial year. In practice this is most of our data.
Where there is a legal reason to hold data for longer (if for example we are in the middle of resolving a complaint) we may retain your data for longer.
Your rights in relation to your data
You can exercise any of the rights below by using the contact details at the top of the page. The easiest way to contact us is by using privacy@likewize.com
Right of Subject Access – You have the right to ask us for a copy of the data we hold about you and some other information about who we have shared it with. You will not have to pay a fee to access your personal data (or to exercise any of the other rights). However, we may charge a reasonable fee if your request is clearly unfounded, repetitive or excessive. Alternatively, we could refuse to comply with your request in these circumstances. We try to respond to all legitimate requests within one month. Occasionally it could take us longer than a month if your request is particularly complex or you have made a number of requests. In this case, we will notify you and keep you updated.
Right of Rectification – You have the right to ask us to correct any information that is wrong. Where that information is a matter of opinion, we might not have to delete it, but you might have the right to submit an explanatory note to be held with it.
Right of Erasure (Right to be forgotten) – This is a complicated right, and you can’t always ask us to forget you entirely. For example, if we have to retain financial data or if you owe us money or we owe you money. But if we do hold data that isn’t strictly necessary, you can ask us to erase that and we will.
Right of objection – You have an absolute right to object to any direct marketing we send you and to tell us to stop. Also, where we have identified our lawful basis as being our legitimate interests you can ask us to stop, and our Data Protection team will consider your request.
Right of restriction – if we are in a dispute about your data or you have objected to our legitimate interests you can ask us to stop processing your data while the dispute is resolved.
Right of data portability – if you are transferring from us to another company there are times when you can ask us to supply your data in a portable format that you can take to the other company. This doesn’t apply very often to what we do but where it does we will help.
Right to withdraw consent – If we are ever processing data on the basis of your consent you have an absolute right to withdraw that consent at any time and we will stop the processing.
The right to complain – We hope you would get in touch with us first and give us an opportunity to put things right or explain. But if you are not satisfied with our response you can complain to the UK Information Commissioner’s Office, their details can be found at www.ico.org.uk
What we may need from you
We may need to request specific information from you to help us confirm your identity and ensure your right to access your personal data (or to exercise any of your other rights). This is a security measure to ensure that personal data is not disclosed to any person who has no right to receive it. We may also contact you to ask you for further information in relation to your request to speed up our response.
